Career Services Terms and Conditions
Bemana’s resume, individual marketing, and coaching services are services of Bemana, LLC. By visiting www.bemana.us or using or purchasing Bemana’s resume, individual marketing, and/or coaching services, Client (hereinafter sometimes referred to as “you”) agrees to these terms and conditions. Please read them carefully. Your use of our website and any Bemana product or service is also subject to our privacy policy and any additional conditions specific to that product or service.
YOUR RESUME
We will never share, sell, disclose, or otherwise use your personally identifiable information without your permission other than to provide you the services you have requested. We reserve the right to utilize format, style, and general appearance of finalized resumes and to modify resumes, cover letters, social media profiles (which would always include removing personally identifiable information) to promote or explain our products and services.
By purchasing a service, you grant us a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to edit, modify, adapt, reproduce, publish, translate, create derivative works from, distribute, and display such content, minus any personally identifiable information. For purposes of these terms and conditions “personally identifiable information” includes your name, address, phone number, email address, names of your employers, and information relating to your academic background.
By submitting a resume or any other document to us, you represent and warrant that you own or otherwise control all of the rights to the content that you submit, that the content is accurate, that use of the content you supply does not violate this policy and will not cause injury to any person or entity, and that you will indemnify us for all claims resulting from content you supply. We assume no responsibility or liability for any content submitted or withheld by you or any other third party.
You agree to provide all necessary and accurate information to Bemana. Your new resume will be written using information gathered from your original resume (if applicable), an initial consultation, desired job descriptions, and any other data deemed useful. If you fail to complete intake processes, you will be subject to incomplete and/or inaccurate information in your new resume. Rewriting or writing beyond the scope of the agreed upon project will be subject to additional fees for consultation and writer time.
SUPPLEMENTAL CAREER DOCUMENTS
You acknowledge that supplemental career documents, such as LinkedIn Profiles, are derived from your resume written by Bemana and will be delivered at the time of the second draft or completion of the resume. Further, you understand that these other career documents are intended to mirror the resume and are likely to have very similar content. Additional requests for writing beyond this scope will be subject to billable hours for writing at $200/hour with a 30-minute minimum.
TESTIMONIAL SUBMISSION
If you submit a testimonial to us, you agree, give permission and grant any necessary license to us to use it, but you agree we are under no obligation to use any testimonial submitted. We may use testimonials in whole or in part. In the event that we do use any testimonial you provide, we will identify you only by first name, last initial, city and state. These terms apply to any testimonial you submit, regardless of the method of submission. Such methods include, but are not limited to, reviews on third-party sites such as Yelp, and Facebook. We reserve the right to review, correct grammatical or typing errors, and edit or summarize testimonials prior to use. If you do not agree with any of these conditions, do not submit a testimonial to us.
SATISFACTION GUARANTEE
We are committed to providing you with a professionally written resume that meets with our high standards of quality, which are based on communication with recruiters and employers across multiple industries, as well as feedback from former customers. If you are not satisfied with the service you receive, please let us know and we will work to address your concern. Please note, however, that individual job searches are subject to extensive external factors beyond the scope of Bemana’s control, such as economic considerations, geographic constraints, employers’ own personal preferences, and applicants’ specific skill sets, experience levels, education, and other attributes. As such, Bemana does not guarantee that any customer will receive an interview or job offer after working with us, and makes no warranties regarding future interviews or job offers, either express or implied.
PROJECT TIMELINE (Resume & LinkedIn)
At the start of each project, you will be assigned a due date to turn in your intake documents (old resume & other documents). Once you turn in your intake documents, Bemana will setup a phone/video call for an initial consultation. From there, Bemana will use its best efforts to submit a first draft of the resume within 10 days after which you will have 5 days to submit their feedback. Failure to submit feedback within 5 days will constitute an acceptance of the draft as final. Once a draft is final, you may request revisions at the billable hourly rate of the writing team (presently $200/hour).
Two revisions are included in the project. The first revision will include client’s recommended edits to adjust resume for industry standards, accuracy in their work experience, and preferred writing style. No major rewriting and/or adding of information will occur after the first revision. The second revision is simply for minor edits and proofreading. While Bemana will make every effort to ensure that the career documents are 100% free of errors, proofreading is your responsibility. You must review proof/draft copies and request revisions. Any revisions past two will be billed at the hourly rate of the writing team at $200 per hour with a minimum of half an hour.
Your project will be created by Bemana based on information provided at the time of initial consultation and documents submitted to Bemana. If you submit supplemental documents for Bemana to review in order to craft a new resume, those will be billed at additional hourly costs of $200 per hour with a minimum of 30 minutes. If additional or new information is introduced after first draft is provided, additional fees for consultation, writing, or revisions may be applicable. If you fail to submit the correct information or omits information needed to create the ordered document(s) accurately, Bemana is not obligated to include this information after the client documents have already been started.
REFUND POLICY
You understand that the project prices take into account Bemana’s expertise, skill, time, and project complexity. Additionally, the project prices take into account client intake time such as emails regarding the project, content writing, formatting/design of products, and proofreading/edits.
If you’re unsatisfied with your order, please contact us to discuss the nature and details of your dissatisfaction. If we receive a request to cancel after a project is paid for, but before the due date for a client to submit their intake documents (old resume, etc.): a 90% refund will be made and a 10% cancellation fee will be retained by Bemana; cancellation after the due date for intake documents, but before writing has begun: 75% refund and 25% cancellation fee will be retained by Bemana; cancellation after first draft is provided to you: 100% of total project price is retained by Bemana.
LINKEDIN PROFILE OPTIMIZATION/CREATION
By purchasing Bemana’s LinkedIn profile optimization/creation service, you consent to providing Bemana, its employees, and contractors with access to your personal LinkedIn profile. You acknowledge that you understand and agree that your professional network, including co-workers, friends, employers and former employers, as well as third parties outside your professional network, including potential employers and recruiters, may see changes to your LinkedIn profile. You acknowledge that Bemana is in no way responsible for any inference or interpretation made by anyone in your professional network, including co-workers, friends, employers and former employers, or by third parties outside your network, including potential employers and recruiters, based on the creation of or changes made to your LinkedIn profile by Bemana on your behalf. You acknowledge that Bemana is not responsible and bears no liability for any action taken by any third party, including your employer or former employer, co-worker, or any other person or entity based on its creation of or changes to your LinkedIn profile. Bemana is not liable for any damages, including but not limited to lost wages, incurred by you due to Bemana’s creation of or changes made to your LinkedIn profile.
INDEMNIFICATION
You agree to defend, indemnify, and hold Bemana harmless from and against any and all claims, losses, damages, liabilities, costs, and expenses, (including, but not limited to, attorneys’ fees), arising from or related to Bemana’s services.
CHOICE OF LAW; VENUE; SEVERABILITY
These Terms are governed by and interpreted pursuant to the laws of the State of Louisiana, United States of America, notwithstanding any conflicts of laws principles, and venue shall rest exclusively in the courts situated in the State of Louisiana, Jefferson Parish. If any part of these Terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining Terms.
ENTIRE AGREEMENT
These Terms constitute the complete and exclusive statement of the mutual understanding of the parties and supersede and cancel all previous written and oral agreements and communications relating to the subject matter hereof. No failure or delay in exercising, on the part of either party, any privilege, power, or right here under will operate as a waiver thereof.
